Terms
Terms and Conditions
These are the terms on which BIG Services Ltd (company number to follow) ("we", "us", "our") supplies gardening, decorating, and handyman services to you ("you", "the customer"). By accepting a quote, paying a deposit, or asking us to start work, you agree to these terms.
1. Who we are
BIG Services Ltd (company number to follow), registered office [address], trading as BIG Services. You can contact us by email at [email] or by post at the address above.
2. These terms
These terms apply to every quote, job, and invoice we issue unless we agree something different with you in writing (including by email). If there's a conflict between these terms and anything on a quote, the quote's specific wording wins for that job only.
3. Subcontractors
We may use subcontractors to carry out all or part of the work. We remain responsible for the work being carried out to the standard set out in these terms.
4. Quotes and quote validity
1. A quote is valid for 30 days from the date it is issued, unless the quote says otherwise. After that, prices may have changed and we may need to requote. 2. Quotes are based on the information and access available to us at the time, including any photos, descriptions, or measurements you or we have taken. If the site turns out to be different once we start work (for example, hidden damage, different ground conditions, or extra materials needed), we'll tell you before doing any extra work and agree a revised price — see clause 6 (Variations). 3. Where a service is marked "quote only," we'll provide a price after visiting the site or reviewing further details, before any work is booked in.
5. Deposits
1. For jobs below our deposit threshold, no deposit is required. 2. For jobs at or above our deposit threshold, we ask for a deposit (a percentage of the total price) before we book the job in. The current threshold and percentage are shown on your quote. 3. The deposit is deducted from your final invoice. If you cancel your booking, see clause 11 (Cancellation) for how much of your deposit is refunded. Deposits are non-refundable once work has started, except as set out in clause 11 or where we're unable to complete the work through our own fault.
6. Variations
If, once work is underway, we find that more work, different materials, or more time is needed than the quote allowed for, we'll explain why and agree a price for the extra work with you before doing it. We'll confirm the extra work and price in writing (including by email) before we carry it out. We won't charge for anything you haven't agreed to.
7. Access and site conditions
1. You're responsible for giving us safe and reasonable access to the property and any relevant areas (for example, unlocking gates, confirming alarm or key safe codes, and making sure pets are kept away from the work area) at the agreed time. 2. If we can't gain access, or the site isn't ready or safe to work in, we may need to rearrange the visit. Repeated failed access may incur a reasonable callout charge, which we'll tell you about in advance. 3. Please let us know about anything that might affect the job: overhead cables, buried pipes, asbestos, structural concerns, or anything else that isn't obvious from a normal site visit. 4. Parking, any permits, and parking suspensions needed for us to carry out the work are your responsibility, unless your quote says we're arranging these.
8. Materials and waste
1. Unless your quote says otherwise, we supply the materials needed for the job and this is included in the price. 2. If you'd like to supply your own materials, we're happy to discuss this, but we can't guarantee the quality or suitability of materials we haven't sourced ourselves. 3. We remove waste and offcuts created by our work as part of the job, unless your quote says otherwise. Some waste types (for example, hazardous materials) may carry an additional disposal charge, which we'll agree with you first. 4. We are a registered waste carrier (registration number [xxxxx]).
9. Payment terms
1. Invoices are due for payment within 14 days of the invoice date, unless your quote or invoice says otherwise. 2. We accept payment by bank transfer and card (details are on the invoice). 3. Ongoing maintenance plans are billed monthly in arrears (i.e. after the visits for that month have taken place), unless your plan says it's billed per visit instead.
10. Guarantee
1. We guarantee our workmanship for 12 months from the completion date of the job. If something we did is faulty within that period, tell us and we'll put it right at no extra cost. 2. This guarantee doesn't cover: normal wear and tear, damage caused by others, lack of maintenance (for example, a lawn that hasn't been watered), materials that fail through no fault of our workmanship, or issues arising from work or conditions we didn't create. 3. Materials we supply carry their own statutory quality rights under the Consumer Rights Act 2015 (for example, if they turn out to be faulty) — these rights aren't affected by this guarantee. 4. This guarantee is in addition to, and doesn't affect, your other legal rights.
11. Cancellation
If you're a consumer booking work away from our premises (e.g. by phone, online, or at your home)
Under the Consumer Contracts Regulations 2013, you normally have the right to cancel within 14 days of accepting a quote, without giving a reason, and without paying a cancellation charge. We also give you this cancellation information before you accept a quote — you'll see it on the quote acceptance page. [Developer note: the acceptance flow must display this cancellation information before the customer confirms.]
To cancel, you can use the model text below, or simply tell us clearly (by email, phone, or letter) that you want to cancel:
> To BIG Services Ltd, [address], [email]: > I/We hereby give notice that I/We cancel my/our contract for the supply of the > following service: [description of service], ordered on [date], name of > consumer(s), address of consumer(s), signature (if this notice is given on paper), > date.
Getting your deposit back
If you cancel during the cancellation period before work has started, we'll refund your deposit in full within 14 days. If you cancel after asking us to start early, we'll refund your deposit less the amount you owe under "Starting work within the 14-day cancellation period" below.
Starting work within the 14-day cancellation period
If you'd like us to start work before the 14-day cancellation period ends, we'll ask you to give express consent to this (in writing or by email) and confirm that you understand you may lose some or all of your right to cancel once work has started. If you cancel after asking us to start early, you'll be asked to pay for the work already carried out and any materials already bought, calculated fairly, up to the point you told us you were cancelling — this is deducted from the deposit refund described above.
After the cancellation period, or for business customers
Once the 14-day period has passed (or if you're a business customer, from the point you accept the quote), cancelling a booked job may mean you're liable for costs we've already reasonably incurred — for example, materials ordered specifically for your job, or other work we turned down to hold your slot. We'll always try to keep this fair and tell you the amount before asking for it.
12. Our right to cancel or decline a booking
We may cancel or decline a booking — for example, if the site isn't safe to work on, we're unable to resource the job, or we have unresolved concerns about payment. Where we can, we'll give you reasonable notice and explain why, and we'll refund in full any deposit or other money you've paid for work that hasn't been carried out.
13. Photos
We may take photos of the work for our own records and quality checks. We'll only use photos of your property for marketing (for example, on our website or social media) if you separately agree to this. You can withdraw that consent at any time.
14. Liability and insurance
1. We hold public liability insurance of £[amount] and will provide evidence of this on request. 2. We're responsible for loss or damage that we cause through our negligence. We're not responsible for pre-existing damage, issues arising from information you gave us that turned out to be wrong, or matters outside our reasonable control. 3. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited or excluded by law.
15. Weather and other circumstances beyond our control
Some of our work (most gardening and exterior work) depends on the weather. If conditions on the day are unsafe or unsuitable for the job (for example, heavy rain, high winds, or frost), we may need to reschedule.
More generally, if something outside either side's reasonable control stops us carrying out the work as planned — for example illness, supply shortages, or severe weather — we'll let you know as soon as we can and agree a new date with you. This isn't treated as a cancellation by either side.
16. Complaints
If you're unhappy with any part of our service, please contact us at [email] as soon as possible so we can look into it and put things right. We aim to acknowledge complaints within 2 working days and resolve them as quickly as we reasonably can. If you're a consumer and we're unable to resolve things between us, you can also get independent advice from Citizens Advice or Trading Standards.
17. Data protection
We only use your personal information (such as your name, address, and contact details) to provide our services, manage your account, and meet our legal obligations, in line with the UK GDPR and the Data Protection Act 2018. We don't sell your information. Read our full privacy notice at [link], or contact us at [jscott@bigservices.app].
18. Governing law
These terms are governed by the law of England and Wales, and any disputes will be dealt with by the courts of England and Wales.
